Enrolment Terms and Conditions
By en-enrolling a student with Safe Start Swim, the parent/guardian agrees to the following Terms and Conditions -


1. Ongoing Enrolment

Safe Start operates an ongoing enrolment program.
Enrolment is NOT for one school term only. Once enrolled, your childs place will automatically continue from term to term, including from Term 4 to Term 1 the following year. Enrolment will continue until a Cancellation Form is submitted.

Our swimming year is divided into four terms for invoicing purposes. Receiving a term invoice does not mean that your enrolment is limited to that term.

You do not need to re-enrol each term. Your childs place remains reserved for them unless you formally withdraw.


2. Cancelling your Enrolment

If you no longer wish to continue swimming, a Cancellation Form must be completed. We strongly encourage familes who do not intend to continue into the following term to submit thier cancellation form before the end of the current term.

Cancellation requests received during the first week of a new term may be processed for that term. After the first week, cancellations will take effect at the end of the current term.

Simply ceasing attendance does not cancel an enrolment. Verbal notification to instructors and other staff is not considered cancellation. A form must be processed so that Safe Start Swim has a clear record of that request.


3. Term Commitment and Fees

When a student continues into a new term, Safe Start Swim reserves their position in their allocated class.
Our class sizes are limited, and staffing, timetables and available positions are planned accordingly to the swimmers enrolled in each class.

Once the cancellation period has passed, families are responsilbe for the FULL FEES for that term, whether or not the swimmer attends every remaining lesson.

Choosing to stop attending during a term does not reduce the Term Fees owed as these are set at the beginning of each term.


4. Refunds

Safe Start Swim does not provide refunds or credits for lessons not attended because a swimmer -
* changes their mind about continuing
* voluntarily stops attending during the term
* goes on a holiday
* has sport, school or family commitments
* forgets to attend
*does not attend lessons for reasons outside Safe Start Swims control

Where a swimmer voluntarily withdraws after the applicable cancellation period, fees already paid for that term will not be refunded and outstanding term fees remain payable.

Nothing in these Terms and Conditions excludes or limits any rights or remedies available under the Australian Consumer Law.


5. Missed Lessons

Fees are charged for your swimmers reserved position in their class rather than on an attendance basis.

No refund will be provided for individual lessons missed by a swimmer.


6. Illness and Extended Absence

We understand that children become unwell and circumstances can arise unexpectedly.

Normal short - term illness does not entitle a family to a refund for missed lessons. In case of serious injury that prevents a swimmer from participating for an extended period, families are encouraged to contact Safe Start Swim.

Any credit, suspensin or other arrangement offered in exceptional circumstances will be considered individually and does not alter the general cacellation and refund policy.


7. Lessons cancelled by Safe Start Swim

If Safe Start Swim is unable to provide a scheduled lesson due to instructor illness or machinery breakdown, a credit or refund will be issued for the cancelled lesson.


8. Public Holidays and Term Dates

Safe Start Swim follows the SA School Term and are closed on all Public Holidays and School Holidays. Classes that fall on these days are not charged in the Term Fees.


9. Class Placement
Safe Start Swim will determine the most appropriate class for each swimmer based on factors such as age, ability, development, safety and class availability.

As swimmers progress, classes will change to ensure the best possible class for each swimmer. While we try to provide consistency, Safe Start Swim cannot guarentee that a particular instructor or class time is available or will remain unchanged indefinitely.

Occassionaly timetables, staffing and operational changes may be necessary.


10. Payment of Fees

Term Fees must be paid by the due date shown on your Term invoice or according to an agreed payment plan.

Enrolling or continuing a swimmer into a term creates an obligation to pay the applicable term fees, subject to these Terms and Conditions and Australian Consumer Law.


11. Supervision

Parents are not permitted to leave children under the age of 12 unaccompanied at any time while they are in the Centre, including during a Learn to Swim class. Guardians must be over the age of 16.


12. Instructors

Teachers are fully trained and accredited through Austswim, have their CPR Certificates and Working With Childern



13. First Aid

Staff are trained in First Aid and CPR and are authorised to administer such medical assistance as they determine suitable in the event of an accident or illness which may occur to your child/children whilst attending the swim school and agree to meet any expenses incurred herein.


SSSA takes no responsiblity for any accidents or injuries that occur ouside of the swimming pool. All lessons are conducted on pool deck or within the pool safety barrier. Parents and Guardians are repsonsible for the supervison and safety of their children outside of lesson times and when they are not under direct supervision of the instructor within the lesson area.



14. Behaviour

Management reserves the right to refuse entry, suspend or cancel a membership without refund, or request any person to leave the premises if that person does not behave in a responsible manner, uses abusive language, is under the influence of drugs and/or alcohol or does not adhere to the general conditions of entry.

Privacy policy

Safe Start Swim Academy is bound by Australian Privacy Principals and is governed by the Privacy Amendment (Enhancing Privacy Protection) Act 2012 (Cth) (“Privacy Act”), outlining lawful means for which Safe Start Swim Academy collects, uses and disposes of personal information that comes into its possession.

Safe Start Swim Academy may from time to time, review and update this policy to take account new laws and technology or changes to Safe Start's operations . All personal information will be governed by its most recent policy posted.

Safe Start Swim Academy collects personal information from customers and where our customers are children, their parents/guardians.

The information collected is needed for Safe Start Swim Academy to operate it business effectively.
This includes activities not limited to:
(i) Providing swimming instruction;
(ii) Administering our services; and
(iii) Providing relevant information to the person regarding our services.

Use and Disclosure
i) required for health or other emergency reasons;
ii) it is in the interest of the well-being of the person or the person’s child;
iii) to investigate suspected fraud or unlawful activity;
iv) it is required or authorised by law; or
v) it is required for law enforcement.

Information collected is done so fairly and lawfully without being intrusive.

Safe Start Swim Academy will not share this information with any other third parties without that person's consent, unless in the situation of an emergency.

If that person refuses to provide their or their child’s personal information to us, we may refuse to
provide our services to that person or that person's child.


Management and Security of Personal Information
Access and Correction
Safe Start Swim Academy takes reasonable steps to ensure any personal information used is accurate and up-to-date.
Safe Start also takes reasonable steps to ensure that the information in its possession is protected. Personal information that is no longer required is destroyed or by secure means or digitally deleted.

You have the right to seek access to the your or your child’s personal information at any time and to advise Safe Start Swim Academy of any inaccuracy. There are exceptions to this right set out in the Privacy Act. If you make an access request, reasonable steps will be enforced to confirm your identity.

Safe Start Swim Academy reserves the right to deny access to personal information in the even of unproven identity. If you have any concerns regarding a breach of privacy, or to obtain access to your or your child’s personal information, the person should contact:
