COVID POLICY

At YFDC we are committed to doing our part to stop the spread. It remains of utmost importance to stay vigilant and not become complacent.
Therefore we require the following protocols be adhered to:
• Sign in on arrival
• Please utilise the hand sanitisers available
• Everyone is urged to follow social distancing protocols and keep 1.5m apart
• We encourage not only our students, but their families, to remain home if unwell and get tested
• YFDC continues to follow a thorough cleaning plan ensuring surfaces and equipment are cleaned regularly.

PRIVACY POLICY
YFDC is committed to providing quality services to you and this policy outlines our ongoing obligations to you in respect of how we manage your Personal Information.

We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The NPPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information.

What is Personal Information and why do we collect it?
Personal Information is information or an opinion that identifies an individual. Examples of Personal Information we collect include: names, addresses, email addresses, phone and facsimile numbers.

This Personal Information is obtained in your registration process. We don’t guarantee website links or policy of authorised third parties.

We collect your Personal Information for the primary purpose of providing our services to you, providing information to our clients and marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from our mailing/marketing lists at any time by contacting us in writing.

When we collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.

Sensitive Information
Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.

Sensitive information will be used by us only:
•For the primary purpose for which it was obtained
•For a secondary purpose that is directly related to the primary purpose
•With your consent; or where required or authorised by law.

Third Parties
Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.

Disclosure of Personal Information
Your Personal Information may be disclosed in a number of circumstances including the following:
•Third parties where you consent to the use or disclosure; and
•Where required or authorised by law.

Security of Personal Information
Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorized access, modification or disclosure.

When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. However, most of the Personal Information is or will be stored in client files which will be kept by us for a minimum of 7 years.

Access to your Personal Information
You may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing.

YFDC will not charge any fee for your access request, but may charge an administrative fee for providing a copy of your Personal Information.
In order to protect your Personal Information we may require identification from you before releasing the requested information.

Maintaining the Quality of your Personal Information
It is an important to us that your Personal Information is up to date. We will take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date. If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.

TERMS & CONDITIONS

Respect
Students are shown the respect owed to them and are expected to show this to their teachers in turn. This is an adult class, and everyone is expected to act in accordance with mature adulthood.

Attendance
Whilst this is a casual class, attendance is important as this helps to ensure that classes will go ahead and not have to be cancelled. Please try to show up for classes you have stated you will attend.

Media Release
Just like any business, our success depends on our ability to promote ourselves. We will not use dancer’s names with any photographs unless we ask you first. Unless otherwise stated on the registration form, YFDC will take the signing of your form as consent.

Medical Release
By attending adult classes I give permission for YFDC, its owners, members, contractors, all employees, and agents of these parties to act according to their best judgement in providing or arranging for emergency care in any emergency circumstance requiring medical attention.

YFDC Refund Policy

FREE TRIAL FIRST LESSON
Here at YFDC, we are delighted to offer all new students a free trial class, applicable to the first class only. This is designed to ensure all of our students enjoy the YFDC way!

PAYMENT TERMS
All fees are payable prior to the first lesson. Payments can be made online or by direct deposit.

NOTICE OF CANCELLATION
Withdrawal from participation is possible at any time. Notice of withdrawal should be send in writing to lessons@yourfirstdanceco.com.au.

REFUNDS
YFDC will refund 50% of any unused portion of term/class fees paid (on a pro-rata basis) from the date of notice of cancellation received in writing.

Legal entity and ABN conducting the classes (“Studio”)

Registration is incomplete without signature and must be completed before first class.

I hereby request permission to participate in dance classes with the Studio. I understand that this agreement is a binding contract and that the studio is permitting me the use of its facilities and allowing me to participate in the classes in consideration of, amongst other things, signing this agreement and agreeing to its terms and conditions.

Warning
The Studio gives you warning that, while participating in classes there is a possibility of physical injury or death. You may suffer injuries including soft tissue injuries, broken bones, joint injuries, spinal injuries, heart attack and stroke. These injuries may occur as a result of, amongst other things, you slipping, or colliding with other participants.

Release and Indemnity
In consideration of the Studio permitting you to participate in the classes, you agree that the Studio or its owners, volunteers, directors, officers, employees, instructors, agents, independent contractors, servants, representatives, landlords, successors and assigns shall not be liable for: -
(a) any loss, damage or theft of any property belonging to you, or brought onto the premises by you or your guests;
(b) any death, injury, loss or damage of any kind suffered by any person participating in or watching classes, caused in any manner whatsoever, including, but not limited to the negligence of the Studio.

Further acknowledgements and agreement
I acknowledge that I will comply with any reasonable direction of the officials and staff of the Studio in relation to: -
(a) entry and exit to and from the Studio;
(b) the use of the facilities and any equipment in the Studio; and
(c) my behaviour and conduct whilst on the Studio premises.

I agree that I am in a good state of health and I am medically fit and there is no medical reason to prevent me from proceeding with participating in the classes.

This agreement shall be effective and binding upon my heirs, next of kin, executors, administrations, assigns and representatives, in the event of my death or incapacity.

This agreement and any rights, duties and obligations as between the parties to this agreement shall be governed by and interpreted solely in accordance with the laws of New South Wales and no other jurisdictions.

By signing this agreement I agree that it is ongoing and will apply to each and every occasion I visit the Studio.

If any provision of this agreement is prohibited by law or judged to be unlawful, void or unenforceable, the provisions shall, to the extent required, be severed from this agreement and rendered ineffective as far as possible without modifying the remaining provisions of this agreement, and shall not in anyway affect any other circumstances of or the validity or enforcement of this agreement.

I have not relied on any oral or written representation or statement made by the Studio with respect to the suitability of my participating in the classes except as specifically set out in this agreement.
