Peel Aquatic Club Incorporated is committed to providing quality services to you and this policy outlines our ongoing obligations to you in respect of how we manage your Personal Information.

We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The NPPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information.

What is Personal Information and why do we collect it?

Personal Information is information or an opinion that identifies an individual. Examples of Personal Information we collect includes names, addresses, email addresses, phone and facsimile numbers.

This Personal Information is obtained in many ways including interviews, correspondence, by telephone and facsimile, by email, via our website www.peelaquaticclub.org.au, from your website, from media and publications, from other publicly available sources, from cookies and from third parties. We don’t guarantee website links or policy of authorised third parties.

We collect your Personal Information for the primary purpose of providing our services to you, providing information to our clients and marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from our mailing/marketing lists at any time by contacting us in writing.

When we collect Personal Information, we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.

We also collect some information automatically when you visit the BV website via third-party vendors such as Google Analytics. This is aggregated, information collected in an anonymous form and includes information such as the number, date and timing of visits to the website and the pages of the website visited frequently. This information is not personal information and collected for statistical purposes only.

Personal information we collect may be used by, and disclosed to our employees, contractors, third party vendors or volunteers whose duties require them to use it in order to help us fulfil services and transactions with you or to otherwise help us provide goods and/or services to you.

Sensitive Information

Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record, or health information.

Sensitive information will be used by us only:

• For the primary purpose for which it was obtained

• For a secondary purpose that is directly related to the primary purpose

• With your consent; or where required or authorised by law.


Third Parties

Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.

Peel Aquatic Club Incorporated will not charge any fee for your access request but may charge an administrative fee for providing a copy of your Personal Information.

In order to protect your Personal Information, we may require identification from you before releasing the requested information.

Maintaining the Quality of your Personal Information
It is an important to us that your Personal Information is up to date. We will take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date. If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.

By Signing for the below is a consider a written request to become a member as per 5.3.

5. BECOMING A MEMBER

5.1 Minimum Number of Members
The Association must have at least six Members with full voting rights.

5.2 Qualifications for Membership

(a) Subject to rules 5.2(b) and (c) any person who supports the purposes of the Association is eligible to apply for membership.

(b) The by-laws of the Association made under rule 25 may require members to hold specified educational, trade or professional qualifications;

(c) The Association must comply with all legal and regulatory obligations that apply to the Association when assessing eligibility of an applicant for membership;
and

(d) A person under the age of 15 years is not to belong to a class of membership that confers voting rights.

5.3 Applying for Membership

(a) A person who wants to become a Member must:

(i) apply in writing to the Association; and

(ii) be nominated for membership by a Member.

(b) All application forms must be signed by the Applicant and the nominee.

(c) If the Association has more than one class of membership, the application form

must specify the applicable class of membership.

5.4 Deciding Membership Applications

(a) The Committee will consider and decide whether to approve or reject any
membership application.

(b) Subject to rule 5.4(c) applications will be considered and decided in the order
they are received by the Association.

(c) When considering a membership application, the Committee may seek clarification of any matter or further information in support of the application, and may delay its decision to allow for that material to be provided and proceed to consider and decide other applications.

(d) The Committee must not approve a membership application unless the

Applicant:

(i) meets all the eligibility requirements under rule 5.2; and

(ii) applies under rule 5.3.

(e) The Committee may refuse to accept a membership application even if the

Applicant has applied in writing and complies with all the eligibility requirements under rule 5.2.

(f) As soon as is practicable after the Committee has made a decision under rule

5.4(a), the Committee must notify the Applicant in writing of the outcome of their membership application but is not obliged to provide reasons for the decision.

7. CEASING TO BE A MEMBER
7.1 Ending Membership

(a) A person’s membership ends, if the person:

(i) dies;

(ii) ceases to be a Member under rule 9.2(d);

(iii) resigns as a Member under rule 7.2; or

(iv) is expelled from the Association under rule 7.3.

(b) For a period of one year after a person’s membership ends, the Secretary must keep a record of:

(i) the date on which a person ceases to be a Member under rule 7.1(a);

and

(ii) the reason why the person ceases to be a Member.

7.2 Resigning as a Member

(a) A Member, who has paid all amounts payable by the Member to the Association in respect of their membership, may resign from membership by giving written notice of their resignation to the Secretary.

(b) The Member resigns:

(i) at the time the Secretary receives the notice; or

(ii) if a later time is stated in the notice, at that later time.

(c) Any Member who resigns from the Association remains liable to pay to the Association any outstanding fees which may be recovered as a debt due to the Association by the Member.

9. MEMBERSHIP FEES

9.1 Entrance Fee
(a) The Committee may from time to time determine the amount of the entrance fee, if any, to be paid by each Member or each class of Members upon becoming a Member.
9.2 Annual Membership Fee
(a) The Committee may from time to time determine the amount of the annual membership fee, if any, to be paid by each Member or each class of Members.

(b) Each Member must pay the Member’s annual membership fee determined under rule 9.2(a) to the Treasurer, or a person authorised by the Committee to receive payments, as and when decided by the Committee.

(c) If a Member pays the annual membership fee within 3 months after the due date, the Member retains all the rights and privileges of a Member for the purposes of these Rules during that time, including the right to vote.

(d) Subject to rule 9.2(e), if a person fails to pay the annual Membership fee within 3 months after the due date, the person ceases to be a Member.

(e) If a person ceases to be a Member under rule 9.2(d), and subsequently pays to the Association all the Member’s outstanding fees, the Committee may, if it thinks fit, reinstate the Member’s rights and privileges from the date on which
the outstanding fees are paid, including the right to vote.

9.3 Coaching Fees
(a) The Committee may from time to time determine the amount of the coaching fees, if any, to be paid by each Member or each class of Members.

(b) Coaching fees will be charged on a regular basis as determined by the Committee.

(c) Each Member must pay the Member’s coaching fee determined under rule

9.3(a) to the Treasurer, or a person authorised by the Committee to receive payments, as and when decided by the Committee.

(d) If a Member pays the coaching fee within 3 months after the due date, the Member retains all the rights and privileges of a Member for the purposes of these Rules during that time, including the right to vote.

(e) Subject to rule 9.3(d), if a person fails to pay the coaching fee within 3 months after the due date, the person ceases to be a Member.

(f) If a person ceases to be a Member under rule 9.2(d), and subsequently pays to the Association all the Member’s outstanding fees, the Committee may, if it
thinks fit, reinstate the Member’s rights and privileges from the date on which the outstanding fees are paid, including the right to vote.

9.4 Lane hire Fees

(a) The Committee may from time to time determine the amount of the lane hire fee, if any, to be paid by each Member or each class of Members.

(b) Lane hire fees will be charged on a regular basis as determined by the Committee.

(c) Each Member must pay the Member’s lane hire fee determined under rule

9.3(a) to the Treasurer, or a person authorised by the Committee to receive payments, as and when decided by the Committee.

(d) If a Member pays the lane hire fee within 3 months after the due date, the Member retains all the rights and privileges of a Member for the purposes of these Rules during that time, including the right to vote.

(e) Subject to rule 9.4(d), if a person fails to pay the lane hire fee within 3 months after the due date, the person ceases to be a Member.

(f) If a person ceases to be a Member under rule 9.2(d), and subsequently pays to the Association all the Member’s outstanding fees, the Committee may, if it thinks fit, reinstate the Member’s rights and privileges from the date on which
the outstanding fees are paid, including the right to vote.

9.5 Fundraising Levy

(a) The Committee may from time to time determine the amount of the fundraising levy, if any, to be paid by each Member or each class of Members.

(b) The fundraising levy will be charged on a regular basis as determined by the Committee.

(c) Each Member must pay the Member’s fundraising levy determined under rule

9.3(a) to the Treasurer, or a person authorised by the Committee to receive payments, as and when decided by the Committee.

(d) If a Member pays the fundraising levy within 3 months after the due date, the Member retains all the rights and privileges of a Member for the purposes of these Rules during that time, including the right to vote.

(e) Subject to rule 9.4(d), if a person fails to pay the lane hire fee within 3 months after the due date, the person ceases to be a Member.

(f) If a person ceases to be a Member under rule 9.2(d), and subsequently pays to the Association all the Member’s outstanding fees, the Committee may, if it thinks fit, reinstate the Member’s rights and privileges from the date on which
the outstanding fees are paid, including the right to vote.
