Privacy Policy

As a leading street dance school, Project Beats needs a wide range of "personal information" in order to carry out its business. "Personal information" is essentially information from which you can be identified. This Privacy Policy explains Project Beats' approach to the handling of personal information, and how we comply with our privacy obligations.

If you provide us with information about your health, we also strive to ensure that our handling of that information complies with applicable State and Territory health records legislation.

1. What personal information does Project Beats collect and why?

Project Beats collects personal information from its members and from contractors, employees, and people we do business with.

Project Beats needs personal information:
- to conduct our business (eg to administer accounts, charge fees and to communicate with our members and business contacts).

To illustrate, the personal information we collect about our members includes:
- Identification Information, including each member's name, address, contact details (including telephone numbers and email address) and date of birth;
- Health information, is a sensitive form of personal information, so we only collect it with your consent, and we only collect what we need;
- Financial Information, including bank account details and credit card details, as well as information about payment or non-payment of fees.

This information is collected from application forms, and when people attend our venue and communicate with us through our website and email.

We also collect:
- Business Contact Information from and about our suppliers and other people we do business with (eg our landlords). This information is needed so that we can manage our business;
- "Next of Kin" Information, is collected in the case of an emergency. We suggest that our members tell their next of kin that they have been nominated for this purpose; and
- Employee Information. is also collected for human resources purposes.

2. How does Project Beats use personal information?

As indicated, we use personal information to provide dance class services, to manage and administer students and to operate our business.

For example, if you are a member, we'll use your personal information to process any applications, charge you fees for classes and studio hire and administer your account. We will also use your personal information to communicate with you, including answering any enquires you may have.

Unless you tell us otherwise, we may also use members' personal information to mail out special promotions, newsletters and other marketing material.

For instance, Project Beats may email its members information about its own promotions, or those offered by our business partners. If you don't want us to do this, we give you an opportunity to "opt out" from receiving such material by unsubscribing to our online newsletter.

3. Does Project Beats share my personal information with anyone else?

Project Beats will disclose your personal information in a few different ways.

We will disclose personal information if we are under a legal requirement to do so (eg under a court order, or if required under legislation), or if an authorised request is made from a law enforcement agency.

Otherwise, we will only disclose personal information with the consent of the relevant individuals. For example, if you are a member, with your consent (and only with your consent):
- we may provide personal information to Project Beats' dance teachers to contact you to arrange a dance class or private lesson. If the dance teachers are contractors (rather than Project Beats employees), their contracts with us require them to keep your personal information confidential. Of course, all our employees are required to keep your personal information confidential also.

4. How can I access my Personal Information?

Privacy laws give you rights to seek access to the personal information we hold about you.

You can seek access by emailing projectbeats.studio@gmail.com. Generally, we should be able to provide you with access within a month of your request, although we may need more time if your request is complicated. Ordinarily, Project Beats will not charge you for the cost of providing access to your personal information. However, if we do propose to charge you, we will advise you of the relevant charge before we provide you with access.

We try to ensure that all the personal information that we hold about you is accurate, complete and up-to-date. However, we rely on you to help us with this. If you wish to update or correct the personal information we hold about you, please e-mail projectbeats.studio@gmail.com. We will contact you if there is any issue about amending the record of personal information we hold about you.

5. Is my Personal Information kept secure?

Project Beats takes reasonable steps to ensure that the personal information we hold is stored in a secure environment protected from unauthorised access, modification or disclosure. We remind our staff and contractors of the importance of storing personal information in a secure way, and to treat it like confidential information.

6. Anonymity

We are be able to answer telephone questions and provide dance class services without collecting personal information about you, but your personal information is useful if you fall ill.

7. Website/online privacy

As we also collect personal information through www.projectbeats.com.au (our website), this Privacy Policy also outlines our approach to online privacy issues. In that context, it is to be read as forming part of the terms of use for our website.

Generally, Project Beats will handle personal information collected online consistently with the way that it handles personal information collected offline. Other matters specific to Project Beats' handling of personal information online are set out below.

a) Cookies
When you visit our website, we will not collect any personal information unless you chose to provide it to us (eg by sending us emails through our website). However, we may collect certain data that does not identify you (sometimes called "web log information") when you visit certain pages, such as the type of browser and operating system you have. We may also use "cookies" which are small files that are stored on your computer and that manage the security and navigation process of the site. You can choose to block these cookies but some portions of the site may not function correctly if you do. This type of data is collected for statistical purposes only, and while cookies will identify your computer, they are unlikely to identify you personally.

b) Email/SMS marketing
We will not email or SMS you marketing material unless you have consented to this. This is a requirement of the Spam Act 2003. Further, you can unsubscribe from our e-newsletter or other bulletins by using the "unsubscribe" facility contained in each electronic publication we send.

c) Site security policy
Our website uses up-to-date technology to maximise the security of your personal information.

Guidelines

When using this website, you are subject to the following terms, conditions and policies. These can be updated from time to time. Please ensure that you have read and understood the relevant section of the terms and conditions. We cannot be held responsible for any errors caused by failure to read or understand the terms and conditions in full.

TERM FEE POLICY

When purchasing and enrolling in a term, a course, and 10 classes pass or crew membership you agree to the following conditions:

• All classes must be paid in full before the beginning of each term.

• Fees still outstanding in week 2 of the term will incur a $20 late fee.

• Term fees that are carried over to the next term will incur a $50 late fee.

• If you are unable to pay your fees by the specified due date please contact us to arrange alternative payment options.

• Students must register for classes via the website or reception every term.

• Students will not be compensated in the rare event that a class is cancelled.

• Bookings are essential for all courses. Please note that discounts apply for ONE individual person registering for classes. You can only register for one person per registration. Registrations for each individual must be registered separately.

• Numbers are restricted and courses are filled on a first come first served basis.

• Students must report to the reception desk at the start of each class. This allows us to monitor attendance.

• If you miss 4 consecutive classes you’ll be automatically removed from the attendance list. To be re-enrolled a $5.00 administration fee will apply.

• If you miss 4 or more classes during the course you will not be able to enroll in the next level. You’ll have to re-take the same level the following term.

• Some courses fill very quickly and some attract smaller numbers. If your course does not have enough students it will be cancelled and you will be informed. If this happens, your course fee will be refunded in full or you may transfer to another course.

• Catch up classes will be allowed for hip-hop classes by attending another class of the same level, and with permission of the director for all other classes.


CASUAL CLASS FEE POLICY

When purchasing a casual class pass, you agree to the following conditions:

• All payments must be paid in full at the beginning of each class.

• Students must report to the reception desk at the start of each class. This allows us to monitor attendance.


REFUND POLICY

Project Beats offers a 14 day cooling off period from the date of your purchase for cancellations and refunds. After this time, Project Beats does not refund the purchase price for absence, non-attendance, change of mind or any other reason.

Non-attendance – If you miss a class you can do a make-up class at another class (your level or an alternative) before the end of the term. Contact us if you are unsure which classes you are eligible to attend.

Change of mind – If you fail to contact us within the first 14 days of your payment, we cannot offer you a refund or extension of your payment.

IF YOU BELIEVE YOU ARE ELIGIBLE FOR SPECIAL CONSIDERATION, IT IS YOUR RESPONSIBILTY TO CONTACT PROJECT BEATS WITHIN 1 WEEK OF YOUR CHANGE IN CIRCUMSTANCE. PROJECT BEATS WILL TREAT APPEALS ON A CASE BY CASE BASIS AT THE DIRECTOR’S DISCRETION.


PAYMENT OPTIONS

Payment options include: Direct Debit and Credit Card (Visa, and MasterCard) via our website using the cart system. Cash is also an acceptable payment option and must be given to administration staff before you attend class.

All prices include 10% GST.


CODE OF CONDUCT

Project Beats is committed to providing safe, exciting and educational classes for each of our students. We believe that ethics, moral principles, standard practices, and etiquette are important elements in the dance world and should be part of a dancer’s education. In order to provide a safe and uplifting environment for everyone, we ask that instructors and students follow the studio’s code of conduct. It takes everyone’s help to create a positive learning experience. Thank you in advance for working together.


RELEASE OF LIABILITY

By registering to attend any Project Beats classes you agreed to the Release of Liability Agreement:

1. I am participating in classes, offered by Project Beats Dance Studio. I recognise that dance classes require physical exertion that may be strenuous and may cause physical injury, and I am fully aware of the risks involved.

2. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in the Classes. I represent and warrant that I am physically fit and I have no medical condition that would prevent my participation in the Classes.

3. I understand that it is my responsibility to advise the instructor of any injuries or if I am pregnant so the instructor can provide suitable modifications where required.

4. In consideration of being permitted to participate in Classes, I agree to assume full responsibility for any risks, injuries or damages, known or unknown, which I might incur as a result of participating in the lessons.

5. In further consideration of being permitted to participate in classes, I knowingly, voluntarily and expressly waive any claim I may have against the owners, instructors, and assistants, individually or otherwise, of Project Beats Dance Studio for damages, and injury that I may sustain as a result of participating in classes.

6. I, my heirs or legal representatives forever release, waive, discharge and covenant not to sue Project Beats Dance Studio injury or death caused by their negligence or other acts.

7. I will not hold responsible/sue Project Beats Dance Studio, instructors or employees for any injuries suffered by me caused whole or in part by my failure to follow the instructions of you or your employees or by any physical impairment of mine not fully disclosed to you in writing.


STUDENTS

• Students are required to show respect to their instructors and other students.

• Students are required to respect the studio property and premises.

• Students should try to attend all classes, punctually and as a courtesy, apologise when interrupting a class and to advise teachers (in advance when possible) if they will be absent from a class.

• Students are required to revise and practice when preparing for performances, and enroll in the classes as agreed upon for the performance class.

• Students are required to moderate their language, conversation and behaviour when they are representing the studio.

• Students are required to clean up after themselves and maintain clean studios and amenities.

• Students are required to be respectful when other classes are taking place.

• Students are required to use deodorant. Students who perspire excessively should keep a personal hand towel on hand and/or change of clothing.

• Breaching the code, depending on the severity of an incident, one warning will be given, followed by a suspension.

Stealing is not tolerated and will result in immediate expulsion from the school. Whether direct acquisition of another person’s property, not paying studio fees or not enrolling in classes/paying the required fees of the course without prior agreement.
